So the driver has no responsibility at all? If he was more alert and paying attention, he would have seen him run in the street and would have stopped. But since he's an irresponsible driver, he ended up running over a defenseless child.

If the guy was speeding, texting or on his cell phone def he plays a big part in being responsible for hitting the kid if not totally guilty..
