2. This seems to sidestep the argument about the 3/5ths compromise into an economic one; that it had nothing to do with their status as persons, but their status as slaves.
I'm not placated by the fact that abolitionists agreed to this clause; even if it acknowledges the personhood of slaves, it was the opinion of the US judiciary that descendants of African slaves
weren't citizens, and thus
had no rights. This wasn't solidified until Dred Scott., but had essentially been the operating principle of the US since the beginning.
Furthermore, in the Dred Scott case, the SCOTUS ruled based on race specifically, so the decision implied the idea that "all men are created equal, and are endowed by their creator with certain inalienable rights" doesn't include "Negroes".
