Can someone help me understand.

During an election, if you can pay to get negative info on a candidate, why can you not pay to keep it under wraps?
You can't use campaign funds.
Its more complicated than that.




It is acampaign fund violation because it was used to influence the election.

Paying people off = influencing the election

Its basically an unfair advantage to pay people off. Its considered an in-kind donation because the transfer of money offers the benefit of suppressing evidence the candidate doesn't want out there.


1. You can't pay people off to influence the election if you work for the election campaign.

2. You can't use campaign funds to pay them off

3. If the funds were from Cohen, then it violates the amount you can contribute, which is 2700.

4. If the funds were from Trump's campaign, thats...obviously illegal.

The problem is that depending on how payment was made, it might be considered an in kind donation to a campaign. Those need to be disclosed on federal disclosure reports.

In this case it looks like the agreement was made to silence Stormy because it would otherwise be damaging to the campaign. Cohen paying the settlement is a “contribution” that must be disclosed.
Why didn’t Cohen figure that out? He’s a lawyer or maybe he just didn’t care
