BENTON, Ill. —

An 82-year-old man who says he was desperate when he robbed an Illinois bank has been sentenced to 10 weekends in jail.

Federal Judge Phil Gilbert told Arthur Bays that he’s never seen a criminal as old as him. He said on Thursday that he struggled with Bays' sentencing.
Bays had a toy gun in his waistband when he demanded money from a teller at State Bank of Whittington in Benton last July. He got $12,500.

I would sentence him the same, I don't want that old muthafukka dying in jail where there is tons of neglect and a potential lawsuit pops up. Let him sit in jail, and have him on supervised release for 3 years. Let that man die in his home

This is such unrelenting c00nery I'm not even sure if you're trolling or not. Let me get this right, you're aware and concerned about the neglect that exists in prison but also want to shield that very same neglectful institution from litigation? That makes sense to you?

Cac can literally rob you and you still want him to enjoy a weekend at bernies.

In the position as a Federal Judge I would use my influence to defer those who I believe wouldn't benefit from incarceration to be deferred to alternative sentencing outside of prison, that is all I'm saying. This man is 83, how much longer you think he has to live, given the federal sentencing guidelines he prob has to serve a minimum of 5-7 years(depends on criminal history). This guy is going to die in prison for a victimless crime, whose money was insured by the FDIC. The judge gave him a break, I can understand why given the circumstance. The prosecutor office can appeal because obviously the judge sentenced below the federal sentencing guidelines but I highly doubt it. He gets his 2.5 months in weekend jail and then he is locked down on home arrest for 6 months. :yeshrug:It is what it is.

There is alot of cost variables that come included in incarcerating a elderly inmate long term and yes lawsuits is one of em. Best believe this guy gets victimized and hurt or killed, the fed. gov will be hit by his family and most likely win given the history of negligence in correctional facilities. Not everything is black and white and the judge saw that and decided to step in and deviate from the federal guidelines for this particular case.

You talk all this c00n shyt but I bet if you was a prosecutor you would be throwing the book at every black defendant that steps in the court room to prove a point. :camby:
