Generally speaking the FBI doesn't investigate domestic violence crimes. It's a state crime. There are a few instances that rise to the level of a federal offense. That being said, the FBI doesn't prosecute anyone. They refer the case to an AUSA, who decides to prosecute or not. The AUSA most likely kicked it back. I have seen AUSAs decline some pretty solid cases because they weren't sexy enough. No AUSA wants to be tied to Angeline Jolie. They would be laughed at by their peers.
