the breh's falling into the trap of thinking that "well regulated" means "supervised by government regulators." when the bill of rights was written, this meaning of the word wasn't part of the english language, the only meaning was "balanced/in good working order," like "a well regulated breakfast." there's been plenty of analysis on this, search google scholar or w/e for "prefatory clause."
Might wanna look at the 13th Amendment while he's at it.
it always trips me out that ppl think the 13th abolished slavery when it really enshrined it for a certain class of people, this amendment needs rewriting to totally abolish it. while we're at it the 2nd needs rewriting too to make NFA '34, GCA '68, FOPA '86, etc. all facially unconstitutional.
