WASHINGTON — The U.S. Occupational Safety and Health Administration has announced that it will be formally withdrawing the Biden administration's vaccine and testing mandates at private workplaces.

The move comes after the Supreme Court's conservative majority all-but-struck down OSHA's requirement that employers with 100 or more employees require their workers to be vaccinated against the coronavirus or tested weekly. However, it did leave in place a vaccination requirement for health care workers.

The OSHA requirement for large businesses would've impacted about 84 million Americans.

"OSHA strongly encourages vaccination of workers against the continuing dangers posed by COVID-19 in the workplace," the U.S. Labor Department said in Tuesday's announcement.

Earlier this month, the Supreme Court ruled OSHA appeared to overstep its congressional authority to implement occupational standards, saying, “Although COVID–19 is a risk that occurs in many workplaces, it is not an occupational hazard in most.”

While the court left open the possibility for the U.S. to pursue more targeted mandates, White House officials said there were no immediate plans to seek a redo of the regulation.

Many large businesses that had already put in place vaccination-or-testing requirements indicated they had no plans to reverse course. But some, including Starbucks, have reversed their policies after the court's ruling.

Last week, a U.S. judge in Texas issued a nationwide injunction barring the federal government from enforcing a requirement that federal workers without qualifying medical or religious exemptions be vaccinated for COVID-19. The Justice Department said it would appeal the ruling.

Correct me if I'm wrong but osha or cms is still finding loopholes through "covid vaccination reports amongst staff" penalties.

Im in Florida so I can't speak for other states. All I know is that healthcare facilities here including mine report the vaccination status of employees and fines are issued off that.

So my job can't force staff get vaccinated but they have to submit their status by the 27th and its reported that potential fines to the facility will follow afterward

A lot of these major companies wanted the vaccine mandate and are still going to go through with it in spite of this decision. It's a major L for the Biden Administration anyways, but even they knew that which is why they dragged their feet in actually crafting the mandate.

But now they can’t fire people bc of it. They will lose in court

Ehhh that's not necessarily true as we've seen the Supreme Court rule in favor of employers and schools so far when it comes to their own vaccine mandate and that was even before Biden's mandate got announced. The problem was that Biden was overstepping his boundaries in trying to mandate it himself, which the Supreme Court had already told him not to do before months ago with the eviction moratorium.

It's not the end of it though as we're going to see more and more lawsuits as private companies still go through with their own vaccine mandate. For most companies, they're just going to pull the mandate and save themselves the headache in the process. Some are still going to go through with it though like what we're seeing with Apple and Nike as they were more than likely already well aware of what the decision was going to be.

They've been happening for months (even before the mandate was announced), with the courts already ruling in favor of business and private institutions. This decision likely isn't going to change anything at all. Biden himself can't mandate the vaccine, but it doesn't mean that private companies and institutions can't do it themselves.

That's the important point to remember.

We'll see. This was a federal mandate before it was overturned
