“The only one who had gunshot residue on his hands was the driver who was killed in the police shooting. Casings found on the scene are not positioned to be consistent with [Alexander] firing from inside the car,” the memo said.

An independent witness told police that he saw the driver — not Alexander — shooting.


That police report “was not provided to the state until months after the filing of the information in this case,” the memo said, adding that one of the men in the BMW “gave a statement to us indicating that the driver of the vehicle, and not [Alexander], was the shooter.”

In the memo, officials said that as a result of the conflict between the initial witness statement and the subsequent witness statements and physical evidence, “we have determined that the state cannot in good faith go forward as this case cannot be proven beyond a reasonable doubt against Jeffrey Alexander.”

“Based on the State’s investigation, the driver of the vehicle, killed in the police shooting, was the shooter,” the memo said.

A Brooklyn-based drill rapper was arrested after landing at John F. Kennedy airport Sunday morning and later charged with attempted murder in connection to March shooting, police and sources said.

Rapper 22Gz, whose real name is Jeffrey Mark Alexander, faces charges from a March 6 early morning shooting inside a Marine Park, Brooklyn party hall where a 31-year-old man suffered a gunshot wound to his left foot, the NYPD said.

The victim had provided a description of the suspect before he was transported to Brookdale University Hospital for treatment, sources said.

The 24-year-old rapper was also charged with second-degree assault, two counts of second-degree criminal possession of a weapon and first-degree reckless endangerment, police said.

He was arraigned in Brooklyn Supreme Court Monday night and his bail was set at $500,000, which he was expected to post with the help of bondsman to the stars Ira Judelson, sources said.

Back in 2017, 22Gz, then 19, was accused of killing a man over a parking spot fight in Miami Beach, though prosecutors later dropped the charges after he was in jail for several months, according to Local 10.

In 2018, he was charged with criminal possession of a weapon, criminal possession of marijuana and criminal trespassing after he was found with a large quantity of weed and a taser in a Brooklyn basement, according to police sources. It’s unclear if he was found guilty of those charges.
