What is Marsy's Law​

Marsy's Law is a nationwide campaign that seeks to place crime victim rights in state constitutions. It was first enacted in California as Proposition 9 in the November 2008 general election, amending the state's constitution and certain penal code sections to provide additional rights to victims of crime.15 The law grants 17 rights to victims in the judicial process, including the right to legal standing, protection from the defendant, notification of all court proceedings, and restitution.1
The law is named after Marsalee (Marsy) Ann Nicholas, a University of California Santa Barbara student who was stalked and murdered by her ex-boyfriend in 1983. Her family's experience of encountering the accused killer in a grocery store shortly after the murder, without being informed of his release on bail, inspired the creation of Marsy's Law.5
The initiative was led and sponsored by Marsy's brother, Dr. Henry T. Nicholas III, who is also a philanthropist and leader of the victims' rights movement.5 Since its passage in California, Marsy's Law has been approved by voters in other states such as Florida, Georgia, Illinois, Kentucky, Nevada, North Carolina, North Dakota, Ohio, Oklahoma, South Dakota, and Wisconsin.5
Critics argue that Marsy's Law unconstitutionally restricts defendants' rights by allowing prosecutors to withhold exculpatory evidence under certain circumstances and can harm victims by restricting their rights to discovery, depositions, and interviews.
