Coachella sues Ghana’s Afrochella for trademark infringement​

Coachella and its organisers Goldenvoice have filed a trademark infringement lawsuit against Ghana-based festival Afrochella.
According to the suit, which was filed in a California federal court on October 5, Goldenvoice claim that Afrochella (via Pitchfork) is “intentionally trading on the goodwill of well-known Coachella and Chella festivals and trademarks by actively promoting music events in the United States and in Ghana using the confusingly similar mark Afrochella”

The suit continued: “Not simply content to imitate and attempt to trade on the goodwill of Coachella, Defendants even went so far as to apply in Ghana to register Coachella as their own trademarks.”


“Despite repeated requests from Plaintiffs, Defendants have refused to adopt their own distinctive event name, and as a result, instances of actual confusion have already appeared on social media.”
The lawsuit “seeks injunctive relief and damages for Defendants willful infringement in the United States and to protect the public here from confusion”

Back in 2017, former Afrochella boss Edward “Deezy” Elohim took to Twitter to call the festival a “Coachella themed event”.

According to their website, Afrochella “is a celebration of Africa’s diverse culture and the vibrant work of African creatives and entrepreneurs.”
Afrochella 2022 is scheduled to take place on December 28 and 29 at El Wak Stadium in Accra, Ghana.


Coachella is set to return in 2023, with its now-traditional two weekends set to take place between April 14-16 and April 21-23.

They will have to rely on IP laws of Ghana. They will ask the local judge to ban aFROCHELLA house that name.

Edit: I think they are suing in the States, not in Ghana. They will probably ask for any comical for it in the States to cease.

There's like 1000 different fashion weeks, including in Africa.
The equivalent would be that Coachella Music Festival sues someone for calling their shyt Jasons Music Festival.

This is obvious thievery, they are promoting it as a Coachella like festival and doing it in the US as a tourism thing. As if Coachella has an African festival.
If you are doing business with major label artists and expecting people to pay thousands for the trip, you better have your shyt correct.

They did not say it's Coachella in Africa
They said Coachella like theme
Unless they patented the term Chella where is their leg to stand on imo

They a should just focus on their focus, how we gona get reparations of the whites can't even have our own spin off fukin music events

We don't blast them for putting on Reggaeville in Rototom and they blatantly transplanted the entire concept from the West indies
What a pathetic reach it shows their desperation

Ok lets try this again... You can trademark/copyright anything.. So meaning of a name doesn't matter at all when someone can trademark the word APPLE...

The name is COchella.. It is trademarked for concerts...

So if you do concerts and your name is SOMETHINGchella, you're treading pretty fukking close... If you take another step and literally say "we are like cochella" you've told on yourself... And if you take another step and try to register the brand you are copying in your own country...

It's a bunch of different companies and groups, who will sometimes use the word Kidchella, and get away with it, cause cochella don't give a fukk and nobody is confusing the two... Now I'm sure if a company started Kidchella as a yearly concert event, guess where they'd find themselves.... fukked up in court


I mean you're talking to someone with several copyrights and trademarks.. That shyt is iron clad. You do not fukk with someone's trademark or IP or they'll wrap your shyt up quick
