Of course none of this can be proven. Thus conspiracy theory. However, I know of someone who knows players in the league. And we know the rumors about Lebron, Wade, Kobe, Melo etc. using HGH. This person told me it was just for the top tier players like them. Anyway, since the new commissioner they knew he wasn't going to tolerate it. And Stern didn't care.
