I work for a major bank. Last month I made a thread about how HR wanted time to talk to them cause I mentioned I was retaliated against in an email, and that email was immediately sent to them.

Basically, I ended up filing a claim with the EEOC. I was already getting laid off at the time I filed the claim, but hadn’t got my severance package and lay-off date.

Well fast forward to right now. My company wanted to go straight to mediation. We have a date set for middle of January to mediate at the EEOCs office.

One thing I learned from my own observations, and from what the EEOC told me is, that if people filed these claims with one or more other people, companies usually ended up cutting a check. The EEOC told me most people don’t want to mess up their jobs though.

I get it, but man fukk that. Last year, they were trying to wrongfully fire me. Now they may have to cut me a settlement check. All cause I spoke up for myself.

Now I will say that, if you go to war with your job while you work there, you better be ready for war. I’m that nikka at the job, so yesterday a girl called me and told me HR contacted her about some meeting I walked out of and said the shyt was stupid. And I did cause it was. But the girl told them it never happened and I did nothing of the sort. It was only me, her, and a white girl in there. But they failed on that attempt cause shorty said the right shyt, recorded the call, and sent it to me. Another chick told me today they emailed her Monday to verify I was there lol. She said she never responded (of course I was there) So it made me realize, although they accepted mediation, they still trying this fukk shyt to discredit my character and possibly fire me.

So those two attempts failed. Today they called me in and gave me my lay-off package. I got 50 days to sign it. But instead of having to come to work, they told me I can go and get paid till my last pay date in February. They gave up and said just send this nikka home lol.

So I’m at the crib till feb, getting paid. And I have a mediation session with them in Jan. These crackers gonna have to cut a young check for ya boy. Now they did pick the latest date so the timing will probably make me have to choose on keeping my severance or declining it and fighting for the settlement. I’m a real nikka. A real nikka gon fight.

The point is, people have to know their rights and not be scared. Also, it’s power in numbers. I’m about to win my shyt dolo. But EEOC told me it’s problematic when employees file claims together. Usually a check getting cut. Don’t be scared of these folks

Hell
I got fired in September but the money wasn't enough to warrant the cause, I do think my speech was a problem but I didn't fight it because I had to sign litigation forms saying I wouldn't sue them.

I learnt my lesson and won't be doing that again.

Above the fray.
Also, if anyone has any experience with mediation with the EEOC, I would greatly appreciate any insight
I went through it ,attending a session with a relative. An attorney was representing her former employer. I was representing / translating for her.

Lot of unnecessary talk, lasted about 1 hr 20 minutes. They will offer settlement to prevent the full EEOC investigation into the incident. I play just as dirty as they do, so weeks before the meeting I sent complaints to OSHA and EVERY possible local, state and fed agency about other bullshyt that was going on at her workplace. Fake name on the complaint of course, but postmarked in the same zip as the job. no vaseline.

I made veiled comments about unrelated complaints/violations in front of the attorney......acting like my relative wanted to settle , but that I wanted the investigation to go through and turn over EVERY rock. ..and that feds would notice a coverup of the violation before they noted the violation. Stared at the attorney and he blinked.

She signed off on the settlement at the end, and it was a lowball....but she took it and moved on.

Stack your money up before you go to war.

I'd put a lawyer on retainer, they're going to work in your best interests, since it benefits their bottom line also. The money they offer could be way off from what you should make based on prior cases, a lawyer could uncover that.

You need to visit a psychiatrist/psychologist for the emotional damage you've suffered as a black man in a hostile environment.:mjpls: A lot of anxiety has been built up and staying up all night thinking about how to rectify your situation and securing a position in the company.

I had similar problems with my school and spoke to the EO about the language they used to remove me from a class.

I'd say record everything. I recorded it everything, when I had to deal with them. Clarification was key, I didn't want ANY misunderstandings.

Although, mine is with the school, rather than employment, I assume the process is similar. A lot of meetings and research into whether your claim is legitimate and whether they can find a pattern for your case. EO seemed to listen to my concerns in a non-bias manner. I hope you take them for everything.

:salute:

I remember an old thread about a questionable firing. Not sure what the outcome was, but worth reading
