Got fired while on workers comp

We had an employee who suffered a stroke and after his short term disability ran out refused to sign his long term disability paperwork and went on SSI...

When short term runs out you technically get "let go and have to reapply" since state pays the long term disability and not the company... so he's been pissed off telling everyone that he got fired while hurt :snoop:

He bought a Kia Soul from my boss too and first thing he said was that he was going to put 24 inch rims on it... :why:

I broke my ankle last week and went on workers comp but was denied for fmla because of not enough hours worked (it's part time) plus I used a lot of PTO the past year. Is there anything I can do or am I fukked?

I broke my hand after a few weeks of work last year and ended up on workers comp. But I'm back working now. I'm sure if it was easy for them to find workers they probably would have tried to get rid of me, but I wouldn't sign anything they tried to give me to sign. So I think I held them off on their plans. Had them folks paying for my medical and didn't sign a thing. Gotta keep them scared of what you might do.

I would look at seeing if a lawyer can help. Or what they think. Might have to pay for a consultation though.

You can get a consolation with a labor lawyer for under $400. shyt some lawyers do it for free.

Companies know the game so if you get fired from a big company, it’s probably legit. Mom and pops might slip up and did you dirty.

How long is short term disability? Isn’t that automatic?

This is a shipping company so they always got workers. And its a big company. Im gonna call a labor lawyer Monday and see what they say but I'm probably assed out.

Yes I provided paperwork from the doctor that said I couldn't work until I was cleared by ortho.
They didnt say anything. I got a notification from the schedule app thar my shift was unassigned. When I try to log in to any work related apps or websites it says "invalid credentials" this happened today.
I sent an email to hr asking if I'm fired I'll have to wait until Monday for a response.

As of now I'm going to assume you're not fired. It's possible that HR put your HR system profile on "leave of absence" which could disable some of your access. Generally that's what the HR department would do when someone goes out on FMLA, Disability, WC or other types of leave. I use to have to do this when I worked in the HR Leave department before jumping to HR Employee Relations. Dealt with FMLA, Disability, WC, other leave of absences and medical work restrictions.

If you are fired then you should get a lawyer ASAP and the people in HR are idiots that should be fired. You might have an unlawful termination case. Employer retaliation for filing a Workers Comp claim.
