They are not using the FOIA to access data, they are using subpoenas. I don't fully understand why they are using subpoenas instead of search warrants, which are traditionally used to get access to cell phone records, text messages, and computer records during a criminal investigation.
Considering that Biogenesis was involved in distributing narcotics illegally, that's probably related to the MLB investigation. I don't know. I haven't been reading that deep into it.

Nope. If that evidence is pertinent to the case, that subpoena is all their lawyers need.

I used to work for the city during the time that there were all those people suing for the RNC arrests from 2004. You'd be amazed how all you have to so is send a subpoena to a telecom company for records and BAM all your shyt right there.

If the Judge signs off on it it's going down.
