Internal memo reveals ICE officers have free rein to detain any undocumented immigrant

Immigration and Customs Enforcement (ICE) agents have been instructed to place any undocumented immigrant they encounter in deportation proceedings regardless of their criminal history, according to an internal agency memo obtained by ProPublica.

Matthew Albence — the executive associate director for the ICE division in charge of deportation proceedings — wrote to the agency’s current staff of 5,700 deportation officers that “effective immediately, ERO [Enforcement and Removal Operations] officers will take enforcement action against all removable aliens encountered in the course of their duties.”

The memo also includes a priority list of undocumented immigrants for ERO officers to detain and put in removal proceedings. But the list appears broad enough to cover all categories of undocumented immigrants, including those who in the immigration officer’s judgement could “pose a risk to public safety or national security.”

The memo represents an even harsher stance toward undocumented immigrants than President Donald Trump has publicly articulated.

Through his campaign and into his presidency, Trump has portrayed undocumented immigrants as criminals, regardless of their backgrounds or their ties to the country. But along with the Department of Homeland Security Secretary John Kelly, who oversees the ICE agency, the administration has indicated it would make exceptions in its immigration crackdowns for some “good” immigrants, including some so-called DREAMers who were brought to the country as children.

An ICE spokesperson told Propublica that the directive “directly supports the directions handed down in the executive orders and mirrors the language ICE consistently uses to describe its enforcement posture.”

However Sarah Saldaña, the former head of ICE for the Obama administration, said that the memo directives are different from the guidance was followed under the previous administration.

Under Obama, who earned the title of “deporter-in-chief” from immigration activists for the record number of deportations that took place under his administration, the majority of the detained undocumented population either had criminal histories or fell into a category where they could be considered a threat to public safety or national security.

“When you use the word ‘will’ instead of ‘may’ you are taking it a step further,” Saldaña told Propublica. “This is an important directive and people at ERO are bound by this directive unless someone above Matt Albence comes back and says, ‘You went too far.’ I don’t think you are going to find that person in this administration,” Saldaña added.

It’s likely that the memo will only generate more fear in the year to come as Trump increases ICE’s resources to detain and deport immigrants. Trump signed an executive order earlier this year to hire 10,000 additional immigration officers. The 2018 fiscal year budget allows for the hiring of 1,000 ICE officers and 500 new Customs and Border Protection agents, the division responsible for border-related immigration activity.

There’s some indication that this memo has been followed closely since it was circulated internally five months ago.

For immigrants, the memo uncovers an unsettling reality that many have already witnessed. Since Trump took office, the biggest increase of arrests has been of immigrants with no criminal records. Other detentions include people with decades-old criminal records or minor infractions.

In a now-prescient meeting with Acting ICE director Thomas Homan in February, Democratic congressional members told reporters that it appeared all undocumented immigrants were “fair game.”

The Winston-Salem, North Carolina, mother who has been publicly fighting her deportation has sought sanctuary at a local church.

After nearly two decades in the United States, Minerva Garcia received an order from Immigration and Customs Enforcement (ICE) to leave the country by Friday. Instead, at a press conference on Thursday, she announced her decision to seek sanctuary at Congregational United Church of Christ in Greensboro, North Carolina. She will remain there indefinitely with her two youngest sons, U.S. citizens ages 3 and 6. Her eldest son, 21-year-old Eduardo, who is blind and a Deferred Action for Childhood Arrivals (DACA) recipient, will stay with friends and family.

“Hearing my mom go through all of this mess is really frustrating. I’m upset,” Eduardo told the crowd gathered at his mother’s press conference yesterday. “I need my mom. I need her to stay. I need my family to stay. They mean the world to me. I hope ICE finds it in their heart to let them stay.”

Garcia appears to be the second undocumented immigrant in North Carolina’s history to seek sanctuary in a church. The first, Juana Luz Tobar Ortega, a mother of four, sought sanctuary at Greensboro’s St. Barnabas Episcopal Church in May.

A solemn Garcia made a few brief remarks, making the crowd laugh when she referred to her 21-year-old son Eduardo as someone who is “still” her “baby.” She asserted that her children need her here in the United States to ensure they are “safe, educated,” and turn into “good people.”

Laura Garduno, a mother, DACA recipient, and local immigrant rights advocate, addressed Garcia from the pulpit, telling her that she was not alone and that the community would fight for her until she could safely walk out the church’s doors.

In an interview with Rewire, Garduno echoed what many faith leaders had said in relation to Garcia’s case: “Man’s law is failing” and until unjust immigration laws are amended, the church will provide a “humane and human response.”

“When I first moved to North Carolina, I remember thinking: Why are there so many churches here?” Garduno said. “Now I find myself thinking: Are there enough churches here to take up this struggle?”

I'm not here to cape for racist republicans, but these hispanic illegals are getting me mad. No hate to the hispanic people, but do they really think that any country will tolerate them coming here illegally and committing criminal acts without getting deported? This is a serious cognitive dissonance going on with some of these hispanic activists I'm seeing. There are a few Jamaicans, Hatians who get deported from committing criminal acts, but don't have that lobbying power like the hispanics have in the media. I don't see NGO's from the Jamaican government lobbying the US to keep them bad boi's and gyals as a humanitarian issue. A lot of reggae artists who are even trying to come here LEGALLY to give concerts and push serious money in to the economy with a PROVEN track record of coming back can't even get performer visa's. There's even a few Haitians right now in Fema camps fighting against deportation from fleeing the earthquake in 2011.

If you don't want illegal immigrants here it shouldn't matter what skin color they have.

It seems when people champion immigration reform they think it's code and only mean Mexicans.

When they say threat that isn't code for criminal. That's code for anyone.

If you support deporting illegal immigrants then don't get caught up with whether they are good or bad because the criminals will be arrested anyway.

Undocumented usually means you snuck over the border or overstayed a visa. Both of which are serious felony's and thus, committing a criminal act.

It has been estimated that approximately 40 percent of the illegal immigrants currently in the United States originally came here legally, but are overstaying their visas. Although it is a federal misdemeanor to illegally enter the country, it is not currently a federal crime tooverstay a visa.

Why would any of these people trust what Trump has said? Say, I'm Drug Dealer X(hypothetical), I'm an illegal gun-toting, dogfood(heroin) selling thug. A fed agent(obama) calls me up and say that I can sell narcotics, but don't tote a gun. Now, a smart person who isn't emotionally stunted would know that I'm doing multiple illegal things. Now, another Fed agent(trump) comes at my crib and find all of my dogfood. They arrest me, but I use the example of one of the feds(obama) that promised I wouldn't go to jail. I knew it was wrong to be selling dogfood, but I was doing it anyway. I'm just saying that ICE's full job and other immigration agencies in almost all countries can hold anybody who is in violation for court proceedings. Doesn't matter if you broke 1 law or 15, you still broke the law.



Take my L with pride. It's always good to learn something new. Been to a few of the Caribbean countries and they're super hard on people who overstay their visas.

They are.
Brasil was the same way for me.

To be honest, I always thought it was a crime until 4 years ago when two of my neighbors had their visas expire.
