Jason Pierre-Paul filed a lawsuit Wednesday against ESPN and reporter Adam Schefter for posting his medical records last summer.

The lawsuit, filed in Miami Dade County in Florida, alleges that Pierre-Paul’s privacy was violated — as was the state’s medical records statute — by the report after the player severely injured his right hand in a fireworks accident on July 4.

I agree i think the medical facility would be liable. Still was shady for Schef to publish them though

it was definitely questionable in terms of journalism ethics. .. but still lawful I believe.
It wasn't lawful. fukk outta here. Medical records are private information. Someone publicly exposing a person's medical records without consent of the patient can and should he held liable. Those cacs at ESPN are about to payup for that bullshyt.

I think the key here is the "state's medical statute" and what the statute says and whether ESPN is even subject to it. if it's anything similar to HIPAA, I think Shefty and ESPN are in the clear.

My guess is that statute might be more broadly applied to people beyond health personnel and those that do business with healthcare organizations.

see post above. If you're thinking of HIPAA, it is lawful in that sense.

But you don't even know what the Florida statue says that you're haughtily posting about and is the basis of the lawsuit.

I work in a hospital, even viewing someone's medical records you have to sign onto another system and without a valid reason your flagged and have to explain yourself and can lead to termination

this is the only matter I think that might lead to a settlement. .. but reporters get leaked, sensitive, personal material all of the time write about it. I'd say he didn't obtain unlawfully but via illgotten means. ..but publishing of the actual record tho. ..

I think the Privacy breach centers on whether the record could be published at all.

Dont nfl players sign away certain medical rights or something when they first enter the league

I remember this being talked about when his records were first released and alot of people were saying it's nothing he could do because nfl players sign something so that their medical history can be shared amongst teams

I never looked into it so i don't know if its bullshyt or not

I agree with you about them but if it's anything remotely similar to HIPAA then someone will definitely lose their job. Not schefter or anyone at espn but someone at the facility. Statute is up to the patient or if the patient is intubated then the next of kin.

Like @Reinscarf said, you better have a damn good reason to look ANYONE's medical record in the hospital. Everyone has a ID that is tracked by the hospital's IT program and they track everything you do. Since I'm in pharmacy, medicine is the lifeline of the patient so therefore I have free access without any repercussions for looking at patients record but if you're in a RN working in a hospital and your unit is rehab, then you shouldn't be looking up a person in tele-onc or ICU.

My guess is that a nurse leaked the info. I know hospital staff gets grilled all the time about the do's and dont's of when you have a celebrity patient. So I'm fully confident it was one of the nurses who had direct treatment of JPP to leak it, it's the only way that not to send off a red flag to IT.
