Speculation is swirling that Supreme Court Justice Anthony Kennedy could announce his retirement as early as this term, The Associated Press and CNNreported Saturday.

Kennedy is considered the most pivotal justice on the Supreme Court, often known for casting the tie-breaking vote in key decisions.

While he's among the court's conservative justices, he has sided with his liberal colleagues at times, including on the court's 2015 decision in Obergefell v. Hodges, permitting same-sex marriage nationwide.

But Kennedy, now 80, is said to be considering stepping down from the Supreme Court, according to CNN, though he has not publicly signalled he will do so in the next year.

Fueling such speculation is a reunion between Kennedy and his clerks happening over the weekend that was pushed up a year from its original date, according to the AP.

If Kennedy leaves the Supreme Court in the near future, it would pave the way for President Trump to further shape the court by nominating his replacement. Trump's first pick for the court, Justice Neil Gorsuch, was confirmed in April.

Supreme Court nominations, however, have become increasingly political. Senate Republicans voted earlier this year to change the chamber's rules to require only 51 votes to confirm nominees to the high court, amid efforts by Democrats to block Gorsuch's confirmation.

Look at the seats that are up for election in 2018

None of the red states look favorable for the democrats and given recent trends democrats may be in danger of losing a seat or two in Michigan and Wisconsin.

Yeah, I think Dems are going to be disappointed in 2018 as far as the Senate goes, due mainly to the map. R incumbents simply have to hold those 7 seats, all of which are in very conservative states, and R's are already at 50 plus Pence as the tiebreaker.

Meanwhile look at the red states Dems have to defend: West Virginia, Montana, North Dakota, Missouri, Indiana plus states Trump won that may/will have open seats Arizona, Wisconsin, Ohio, Pennsylvania, Florida and another two swing states in Maine and Nevada.

If anything, R's could have a mediocre cycle and come out ahead of where they are now.

this would be horrible, not as horrible as a liberal retiring or dying, but almost because kennedy is a moderate. scalia's replacement didn't change anything (it would have if obama appointed his replacement), but kennedy's replacement would be a game changer.

a lot of folks don't realize how horrible this country would be to live in for a lot of people if we had a far right court. i just got a few more years though.

This would demoralizing for the supreme court. Affirmative action, abortion rights, healthcare can all be dismantled with Trump next pick.

Fuk social issues - you don't get props for upholding what previous courts have ruled. that's called being true to stare decisis, the underpinnings of our supreme court jurisprudence.

Look at his votes on economic/political questions (citizens united, voting rights, corporate power, bush v. gore). This is where the court has turned hard right.
