Did you miss the part where he was working for/with Jiraiya?
That's the whole "excuse y'all bank on to save yourselves from the truth" bit. Protecting the leaf didn't stop him from attacking every other Leaf ninja he dealt with, he just never went as far as killing them...but Jiraiya came through and dude high tailed it.

Jiraiya got sonned by Pain.......along with every other ninja that faced Pain before him. Pain admitted J-man would've bodied him if he knew the secret 
And Itachi taking orders from Pain
