A man accused of meth possession and pointing a BB gun at a Billings police officer in July pleaded guilty Tuesday to two felony charges.
Appearing in Yellowstone County District Court, Bryon James Hemming, 29, admitted guilt to drug possession and assault with a weapon.
Police arrested Hemming after an early morning incident at North Park on July 27, records say.
An officer on patrol reported going to the park to investigate after seeing open alcohol containers and trash near two people at the center of the park. One of the two, later identified as Hemming, started to quickly walk away and then started running while holding a large silver pistol, court records say.
The officer yelled for Hemming to stop, but he continued running.
The officer used his patrol car to cut off Hemming and radioed for backup. As the officer approached, Hemming turned and pointed what appeared to be a pistol at him, charging documents state.
Hemming eventually dropped the gun, but continued running. Police chased him on foot, and he turned toward the officers. Officers brought Hemming to the ground, but he continued to resist arrest even after being shocked with a Taser, according to prosecutors.
Hemming was arrested and taken to the jail. An officer noted that Hemming appeared to be high.
Another officer reported finding a smashed glass pipe in Hemming’s pocket. Hemming claimed the glass was from a bottle of cologne, but the broken glass later tested positive for the presence of meth, charging documents say.
The gun Hemming had been carrying was retrieved and appeared to be an exact replica of a stainless steel Beretta 92 pistol, court records say.
Judge Michael G. Moses scheduled Hemming for sentencing on April 27. Hemming’s plea agreement calls for dismissal of a misdemeanor drug paraphernalia charge.
