A 29-year-old man who had admitted assaulting his wife in March — less than one week after he was sentenced for beating the same woman — was given nine years of probation Tuesday.
Yellowstone County District Court Judge Gregory R. Todd gave Brian Edward Shibley a five-year suspended sentence in the most recent case and then gave him a new sentence of four years suspended in the earlier case, for which Shibley had initially been given a deferred sentence.
In the more recent case, police arrested Shibley after they responded to a domestic disturbance report on March 9 at a residence in the 600 block of Custer Avenue, charging documents say.
Officers spoke with the victim, who had marks on her neck, court records state. The woman said that she and her husband had gotten into a fight and that he had called her names, including “whore” and “slut,” and told her she was “worthless.”
She said that Shibley then started breaking and throwing things in the house and used both hands to lift her off the ground by her neck.
That incident came after a judge had sentenced Shibley on March 3 for a felony count of partner or family member assault. In that case, he punched his wife in the face, giving her a bloody nose.
Shibley was convicted of domestic assault in 2010 and 2011, records show.
Deputy County Attorney Mary Leffers Barry had asked for a sentence that would have totaled 10 years of suspended time. Shibley’s attorney, Jeffrey G. Michael, argued for a sentence that would have totaled eight years.
