MONTGOMERY VILLAGE, Md. (WJLA) -- A man tried to rape a 12-year-old girl while his wife prepared to give birth to their unborn child at the hospital, Montgomery County Police allege in court documents obtained by ABC7.
Luis Perez-Giron, 28, of Montgomery Village, is charged with two counts of third-degree sexual offense stemming from what law enforcement sources have called a "mind-boggling case."
Based on court filings, Perez-Giron's wife is close friends with the victim's mother. Earlier this year, the victim's family stopped by Perez-Giron's apartment along Lost Knife Circle in Montgomery Village for a friendly get-together.
While the adults chatted in the main living area, the 12-year-old victim, her two-year-old sister and Perez-Giron's five-year-old son listened to music in the master bedroom. At one point, Perez-Giron allegedly walked into the room, sat down on the bed and kissed the victim on the neck. He proceeded to touch her breasts and genitals, according to court documents.
"Perez-Giron told Victim A not to tell her mother or he would come to her house and hurt Victim A's family," a detective with Montgomery County's Special Victims Investigations Division wrote in court documents.
The victim fought back. Perez-Giron ultimately gave up, but not before allegedly threatening to rape the girl "when she turned 13."
Months later, on May 8, Perez-Giron's wife went into labor. She contacted the victim's mother to ask if they could watch after their 5-year-old son during the delivery process. The victim's mother agreed.
Police say a short while later, Perez-Giron arrived at the victim's Gaithersburg apartment and let himself inside. The victim — who was home alone at the time — had locked herself in the bathroom out of fear of what the 28-year-old might do to her, authorities say.
After some time had passed, the victim tiptoed out of the bathroom, but Perez-Giron was still lurking in the apartment, police say. Perez-Giron allegedly guided the girl — 16-years his junior — to the couch where he touched her breasts and tried to remove her pants. Yet, the girl fought back and ran back into the bathroom.
After passing more time, the girl poked her head out the bathroom door and did not see Perez-Giron in the apartment. But as the 12-year-old walked out, Perez-Giron reportedly jumped from a closet and pushed the girl to the ground, causing her to slice her hand.
The 5-foot-6-inch, 135-pound father-to-be forcefully yanked the girl back onto the sofa, ripped off her shirt and camisole and began to touch and kiss her breasts, police say. Perez-Giron proceeded to pull down the victim's pants, but she managed to fend him off yet again, police say. Defeated, Perez-Giron allegedly ordered the girl to stay quiet and vowed to re-attack her in the near future.
"Perez-Giron told Victim A that he was going to rape her when she turned 13," police wrote in court documents.
This is not Perez-Giron's first brush up with law enforcement in the state of Maryland. In February 2017, Montgomery County Police arrested him for first-degree assault, second-degree assault, resisting arrest and public intoxication. Two months later, prosecutors dropped all charges for unknown reasons.
According to court documents, Perez-Giron and his wife have three children. The Guatemalan native had been working as a mechanic up until his arrest.
Citing the severity of the allegations, Montgomery County District Court Judge Zuberi Williams denied bond. Perez-Giron remains in Montgomery County custody.
Perez-Giron faces up to 20 years in prison. He is scheduled to re-appear in Montgomery County District Court on September 6, for a preliminary hearing.
