Taping signals was legal through his first 3 super bowls, and all they did was instate a new rule in the handbook saying you can no longer tape from the sidelines, but still can from the stands or sky box.
It was pretty common practice amongst teams to scout signals from other teams.
The memo saying to stop came out in 2006, and the Pats got in trouble for taping from the wrong spot in their opening game in 2007.
