Technically you can sue anyone, you just will pay them something for the rest of your life but yeah It sounds legally fishy. probably some random will have his case picked up by the ACLU and they'll take it to the Supreme Court and it would be thrown out.
I know to be found at fault or guilty in civil court the evidence requirements are lower.
