Utah judge refuses to dismiss rape, sodomy charges against teacher

A judge on Tuesday refused to dismiss charges against Brianne Land Altice, 34. The former Davis High School English teacher’s attorney had argued that Altice was the victim of the persistent 16-year-old.
A Utah judge refused to dismiss rape and sodomy charges Tuesday against a former high school English teacher for her alleged sexual relationship with a student.
Brianne Land Altice, 34, is accused of having sex with the student on multiple occasions from January to September 2013.
Her attorney, Edward Brass, argued that the 16-year-old boy was the aggressor in the relationship, according to local media.
The blond former teacher blows her nose in court Tuesday.
He says the prosecution failed to prove that Altice had a position of influence over the teen, The Salt Lake Tribune reported.
"She repeatedly refused and declined his advances until he ultimately broke down her resistance," Brass wrote in a motion to dismiss the three counts of felony rape and one count of felony forcible sodomy. "The state failed to establish probable cause to believe that the intercourse that occurred was without consent."

But Deputy Davis County Attorney Cristina Ortega countered that teachers hold influence over their students because they grade and can discipline them, according to the local paper.
Judge Thomas Kay listened to both arguments and ultimately denied the motion

The teen testified that he would meet with Altice before school in a church parking lot for sex, reported The Davis Clipper.
Altice is scheduled to appear in court again Aug. 8, and her trial is slated to start on Sept. 15.
She was released on $10,000 bail ever since her arrest and was fired from her position Feb. 3.
Her husband filed for divorce and custody of their child in December.
