Need advice: Caused a finder bender how to proceed?

I work for a concierge car service as a driver on weekends.

I had a 12 hr booking, driving a Sprinter. I stupidly backed into a SUV on a back road (we were in the street about to leave and they were directly behind me and I wasn't paying attention to the rear view camera). The front bumper of the SUV got bent, that's it, no other damage (I was going about 5-7mph). Sprinter is fine as well. The owner of the SUV that I hit belongs to a different unrelated car service as well, so its not owned by a private individual.

The owner of my company "leases" or "uses" this Sprinter from another person who rents them out. I provided my own insurance info (the Sprinter insurance and registration information wasn't in the vehicle) but the owner of the sprinter doesn't want to use their insurance, they want to pay out of pocket. I just started a new job with no extra money for this expense.

What's the best way for ME to go about this? Should I use MY OWN PERSONAL CAR INSURANCE to cover this, demand the Sprinter owner use his insurance to cover it or pay out of pocket?

Are you a contractor or employee?

I suppose I'm a contractor. I don't get an official pay stub, its via cash app. Honestly, there's no paperwork. If I'm available I take the booking and get paid after via cash app.

Wait. Y’all doing some backhand under the table business and you’re using other peoples’ cars you don’t own? :what:

Anyway y’all sound type shady. You should already be listed under the company’s insurance as you’re a hired driver. But in your situation since there’s no paperwork have the company’s insurance handle it or just quit if they force you to cover it.

Well since there's no paperwork, that benefits you (and I doubt you'd legally classify as an IC even if there was) but ultimately its up to you. I wouldn't pay though. The owner's an idiot and has to eat the L

If the damage aint outragous I'd just pay out of pocket. If you dont have specific insurance for being a concierge service then that shyt will be a headache. Will have to wait forever for inurance companies to do shyt and provide all kinds of documentation when you could just slide homie some bread and call it a day.

And usually if you cause an accident it's in your best interest to pay for it out of pocket if you can afford to.

I needed extra cash and the owner of the service
needed some help covering bookings when their other drivers were unavailable. It was fairly easy extra cash.on the weekends that paid more than Uber without using my own car. I use theirs.

I wouldn't be worried at all

Thanks! The Sprinter has to have insurance because the police officer would have clocked it. The owner just doesn't want to use it, they want to do everything under the table.

Whatever insurance the car is under is the one who should pay. Like 7 years ago somebody ran into my car with a uhaul truck, and they left their insurance information. I called their insurance and they said they weren’t going to pay. So I called uhaul, and they took care of it. Then like a week later his insurance company called me back, and said we’ll go ahead and pay for it, who should we send the check to. Pocketed a little over 5k. Ordered the light, and put it in myself

Most personal insurance companies will deny coverage if you admit to driving under a car auto business during the accident.
Don't pay out of pocket because they can still file under your insurance and by some miracle they approve the claim , your insurance company will pay and you out of money.

It sounds like your company is prob doing something shady and trying to hide their activity from their carrier, ie commercial activity under a personal auto policy.

Do not pay anyone cash.
You lucky they aren't trying to claim injuries which they can still do btw, even if they aren't now.

File it under the vehicles insurance first. That is primary. If your company fights it or wants your insurance to be 100% liable.

Did you sign a contract waiving the companies liaibility and that you assume all liability and damages by having correct auto insurance?

The person I work under has vehicles under personal insurance.

As for the Sprinter, I'm not sure how the insurance is set up for that, since that's under another person who is an independent contractor (it's so convoluted).
