FRANCE — Hyères, Var. A man who identifies as a woman was slapped with a fine and handed a fifteen-month suspended prison sentence after he entered a neighboring room and performed an indecent act on the sleeping occupant.
The Brazilian, whose name was withheld from the press, was on vacation in Hyères, France on the night of June 29, 2018.
At 3 AM, the 33-year-old unlawfully gained entrance into the room of a man who had fallen asleep after watching a football game with a friend the whole evening.
The intruder proceeded to perform oral sex on the sleeping man. The victim woke up and began screaming, and the intruder fled.
The victim alerted the police about the incident, and filed a complaint. The perpetrator was arrested on the charge of Sexual Abuse by Violence, Threat or Coercion.
At the Toulon Criminal Court hearing on August 13, the perpetrator pleaded guilty to the crime. He told the court that, “to finance physical transformation operations,” he is an “escort-girl” in France. Prior to entering, he had realized that he was at the wrong room, but had entered, anyway, he confessed. He blamed his drunken state for the decision to proceed into the room and perform a sex act without consent on a sleeping person. “At the moment I did not reflect on the consequences.”
“When you realized you were wrong about the apartment, you should have left,” the Court Judge said, rejecting the argument. “No, you stayed and carried out the fellatio.”
In addition to the suspended sentence, the perpetrator was ordered to pay the rape victim 2,000 euros in compensation.
The distressed victim feared contracting HIV due to the incident, and underwent therapy while awaiting test results.
The convicted sexual abuser will not have to serve prison time if he abides by the terms of the probation.
