Th judge has to be the most impartial person so any recommendation he makes is tied to the letter of the law.

He's impartial UNTIL the case is over and the defendant has been convicted of something. At that point he is going to hand down a sentence that he feels appropriate. There is a federal sentencing guideline but he can go higher or lower. He is only bound by the statutory limits. So for this charge that's 10 years. If Puff is convicted of that he can say "one year, time served", OR he can say "10 years to serve".
