Breh thought he dodged it, but they came back for him

Olympic athlete Oscar Pistorius has been found guilty of murder after a South African appeals court overturned an earlier manslaughter verdict.

He killed his girlfriend Reeva Steenkamp in February 2013 after shooting her four times through a locked toilet door.

He is currently under house arrest after spending one year of his original five-year sentence in jail.

Pistorius will now have to return to court to be re-sentenced, for murder.

It was earlier incorrectly reported that the court had ruled the manslaughter verdict would remain.

South Africa's Supreme Court of Appeal ruled that the lower court did not correctly apply the rule of dolus eventualis - whether Pistorius knew that a death would be a likely result of his actions.

Reading the ruling reached by a panel of judges, Justice Lorimer Leach said that having armed himself with a high-calibre weapon, Pistorius must have foreseen that whoever was behind the door might die.

Pistorius' lawyer argued that he believed that there was an intruder in the house but the judge said that the identity of the person behind the door was irrelevant.

What kind of fukked up system do they got down there? First they completely fukk up the first verdict so he serves almost nothing but then after he does his bid they change it? And he has to do more time?

Prosecution appealed the decision! Rightfully so, it's murder.

Dude spent 1 year of his original 5 in prison for murdering someone! It was a light sentence even if he did 'accidently' shoot her.

Dude knew she was in there and plus if you shoot 4 times into a door where the person inside has nowhere to hide....then that is murder not manslaughter

Can prosecution appeal in our country? Never heard of that. I'm not saying he isn't guilty or murder but I think it's fukked up you can get sentenced twice for one crime.

I dont think they have double jeopardy in all countries, and they're basically saying:

It's quite long and technical, but here's a snippet from close to the end, explaining one of the legal arguments for the decision taken by the panel of judges in the appeal court:

"In the result, on count 1 in the indictment the accused ought to have been found guilty of murder on the basis that he had fired the fatal shots with criminal intent in the form of dolus eventualis.

"As a result of the errors of law referred to, and on a proper appraisal of the facts, he ought to have been convicted not of culpable homicide on that count but of murder.

"In the interests of justice the conviction and the sentence imposed in respect thereof must be set aside and the conviction substituted with a conviction of the correct offence."

What is dolus eventualis?

It's a South African legal term which refers to unintended but foreseeable murder, a lesser charge than "dolus directus", which refers to deliberate murder.

why would the us even attempt to step on the legal system of africa charging an african (althought white) male for a crime that was committed in africa?









i think oscar pistorius is sexy as fukk. but this case has just been fukked up from the beginning. its :banderas: that they charged this man, he "served" his time and they was like nope :umad:

i do agree its fukked up he "served" his time and now he gotta get re-served, but a loooooot of injustices happen every fukking where and so fukking often in america, people get away with murder and then live their life "free" with no chance of being retried for that crime even if evidence comes up assuring they did it. double jeopardy aint a world wide law. :manny: you win some you lose some, but you live, you live to fight another day
