Our neighbors bathroom flooded and now the landlord is trying to blame us?

Basically a few days ago the apartment downstairs came knocking at like 9pm saying his apartment was flooded and said did we have any water leakage. We told him no(because we didnt)

But da other night, my girlfriend uses the bathroom and when she flushes da toilet the toilet keeps on going and the water wont stop, we eventually had to turn the knob behind the toilet and turn it off untiil maintence came and fixed it.(This was at 2am). We put a bunch of towels on the floor to let it dry and by the mornin it was.
So when maintence come around 10am they fix it. This dumbass maintence dude tho gonna say "I noticed that yalls shower curtain(the linen) was outside the shower, yall should keep it inside so that water doesnt get out"
My girlfriend told me "I always take the linen out from da inside when im not using the shower so it wont get moldy"

So today the same dude comes and gives us a "notice of lease violation" saying that:
"The following violations of your lease were reported:
FLooding of teh apartment below you because of failure to use a shower curtain properly & failure to cleap up water on the floor after toilet overflowed."

blah blah blah

Is this legal?
What can we do?

Check the language of your lease did it violate a clause?

I dont think he can do anything based on the shower curtain thing a reasonable judge would toss that. But the clean up water thing is a possible case if he wants to throw you out.

But ultimately it depends on the language of the lease.

im assuming ur pretty young, since it sounds like he thinks ur stupid :mjlol:
id speak to the manager first,
if u dont give a fukk about ur credit/rental history, id just bounce on em. either way, when ur lease is up they will try to hit u up for damages in addition to keeping ur deposit

What can we do?

Talk to your neighbor who had his apartment flooded as well as all your other neighbors. Contact a lawyer who specializes in Property Law and see if you have a cause of action for "Constructive Eviction" or violation of "Implied Warranty of Habitability". But most importantly: TALK TO YOUR NEIGHBORS. If it's a recurring problem in many apartments you shouldn't end up being liable :ld:
