They can do that, but that doesn't mean a jury or judge will believe them. Circumstantial evidence is huge in discrimination cases because there is almost never direct evidence - you never see an e-mail that says "Let's fire this dude cause he's in a wheelchair." Here, Haden's own sheer incompetence generated plenty of evidence for Sark's side to use, especially with respect to the timing of when he was fired, it coming just a day after putting him on leave to take care of his issues, etc.
This is true but when it comes to coaching, it's one of the most fickle positions one can have. Coaches get fired all the time. The law and ADA does require reasonable modifications to be made for disabled persons..allowing an alcoholic to run your program and do unprofessional shyt just cause he's "disabled" isn't exactly reasonable. Coaches get fired left and right in college sports. The fact he wasn't fired after the first few incidents, although they knew of his drinking issues, shows that the firing wasnt solely because of that. Even if they did fire him for his acholic actions, not doing so would have created an undue burden to the organization.

Makes me wonder the terms of his firing though. Did they pay out his contract, our did they get on that Al Davis steeze? :patrice:
The last check he got was the last check he got. He was terminated with cause(embarrassing the university, missing team activities, already had been reprimanded also.)

fukk Sark, he knows nobody is going to touch him with a 10 foot pole and is now reaching with all his might.
