Resisting Arrest without Violence is a first degree misdemeanor (punishable by up to a year in jail and not more than $1000 fine). Most people incorrectly believe that "resisting" refers to some sort of physical act. It does not. The police may charge you for Resisting Arrest without Violence even if you simply fail to obey an officer's lawful command. Some officers add on this charge when they arrest someone for Disorderly Conduct or Disorderly Intoxication as a way of strengthening the prosecutor's case against the person arrested.
