If you have to be sedated, you want to be able to trust the people who are watching over you. Unfortunately, for a 38-year-old man at Palm Springs Hospital in Florida, this wasn’t the case.
The man, who wishes to remain unidentified, was taken to the hospital on September 15th after experiencing intense back pain. He was heavily sedated and laying down on a hospital bed while ER technician Rene Martinez checked on him.
The patient was horrified when 51-year-old Martinez began to fondle his genitals. Fortunately, the victim had enough control over his body to start filming on his mobile phone, which he propped up on his shoulder.
In the footage above, Martinez was captured sliding his hand into the patient’s boxers and fondling him before leaving the room. The footage only shows the second time Martinez molested the victim.
The victim said:
“I was like, “What’s going on?” and he was like, “I was just checking to make sure you’re OK.” That’s when I say, “OK this guy is up to something.
He [then] came back, put his hand in my boxers, pulled out my private parts and started playing with it, and I was rolling on him doing it the second time.”
According to the victim, Martinez was also making lewd statements to him during this time. Martinez had allegedly told him, “I have a friend who has a hotel and pays guys to show their (private parts). You can make good money.”
During the investigation, police discovered that Martinez had several explicit male websites in the browser history of his cell phone.
The victim said he didn’t call for help while the assault was happening because he was afraid and drowsy from the painkillers he was given. The next day, he complained to the hospital. It was two weeks before the victim felt safe going to the police about the assault, due to traumatization from sexual abuse that happened to the him as a child.
Of the experience, the victim said:
“It has caused me a lot of damage. I haven’t been the same since it happened.”
A lawsuit was filed against the hospital on Monday. Martinez has denied the victim’s claims, however the evidence from the victim’s video stands as proof. Martinez’ attorney, Sabino Jauregui, said:
“We’re going to defend him. We’re going to trial. The alleged victim is a convicted felon with a long history. Things are not always as they appear.”
Palm Springs Hospital has refused to comment on whether or not Martinez is still employed there. Martinez’ hearing is scheduled for January. If convicted, he could spend up to a year in jail.
