Now if a person is intoxicated, Its technically rape because they can't consent in sound mind to sex. And its more to protect women because women are the ones usually getting taken advantage of sexually while drinking..

Even if she says yes during sex, she might not be aware of her actions to consent... So the next day if she regrets it, she still might have a case.. And men as well
