Carlos Ortiz, charged as an accessory, probably will not be a witness against Aaron Hernandez in the murder trial of Odin Lloyd, Ortiz’s lawyer told the Herald yesterday.
“I don’t believe he’s going to be a witness, to tell you the truth,” attorney John J. Connors Jr. said after a hearing was postponed. “If people are going on the assumption that because the court dates were moved around we’re cooperating, or we’re doing stuff because he’s cooperating, that’s not the case.”
Connors said he has to go through stacks of evidence that was turned over by prosecutors yesterday as part of the discovery process, and is concentrating on preparing a criminal defense for Ortiz.
He said prosecutors handed over 200 DVDs and CDs with reams of digital evidence as well as more than 70 police reports related to the crimes Ortiz is alleged to have committed.
Ortiz is charged as an accessory after the fact in the June murder of Lloyd in a deserted portion of a North Attleboro industrial park. Lloyd, a semi-pro football player who lived in Dorchester, was allegedly slain by Hernandez. Prosecutors have said Hernandez was angry with Lloyd for a conversation Lloyd had with some of Hernandez’s rivals at a Boston nightclub.
Ortiz and another accused accomplice, Ernest Wallace, 44, who prosecutors say were with Hernandez that night, are due in Fall River Superior Court in January for a pretrial conference. Wallace’s lawyer could not be reached. Hernandez is being held without bail for Lloyd’s killing and gun charges. Hernandez is also being eyed by Boston police in a 2012 double slaying in the city’s South End.
