Ok even if it's a derivative work does someone have the rights to use the copyrighted material they used in the let's play to create it if the copyright holder says no?

Now we get into fair use and a strong argument can be made that a typical let's play is not fair use. Now if I play 5 minutes of your game and do commentary and that 5 minutes is all I use then that has a stronger case to be considered fair use. If I play your entire game and do commentary over it that has a much weaker chance to be fair use.

If what you are doing isn't fair use then you need the copyright holders permission to use their content to create yours.

Is that nonrevokable permission? Because a rights holder ultimately has the rights and if they decide you're toxic to their brand they can revoke that permission which is the claim here.

Let's say a guy is a popular let's player and does Nintendo playthroughs and it later comes out that he's a child molester. Are you then making the argument that Nintendo shouldn't be able you say they don't want their games associated with said person and takedown the videos?

I agree he is a racist, but I think he said this on purpose. It gets him extra clicks and he's a whore for attention and websites talking about him, so bad publicity is good publicity for him. And because of his place as a YouTuber, he knows he's untouchable anyway.

I personally don't mind if companies get more strict about let's plays on YouTube for current games.

I don't think that's what a copyright claim is for. if they want to say it's misuse of their intellectual property, than I think they at least have to establish that there was something wrong with the video in question

really I think that copyright claims need to be consistent, and not a pick-and-choose thing. they had no problem with PDP when he released the video, and even said in so many words it was OK. they also had no problem with PDP helping them make a bunch of money

I understand why they wouldn't want their game associated with PDP now. but when you put it like "they can do what they want, when they want, because it's their game", it becomes a slippery slope. there needs to be consistency, or it can just become vindictive behavior. I'm pretty sure a judge would at least consider these things

Why does it have to be consistent when the uploader doesn't have the rights to the copyrighted content they're using in the first place? This is something they allow to exist with on their own whims in the first place out of good will.

Fair use exist to protect content such as criticism from that sort of abuse but criticism has a value and should be protected. A lets play is someone effectively piggybacking off another's copyrighted work and if it's monetized making money off it.

If you let one person use something you own does that then mean you should let everyone who wants to use it do so? Do you not have discretion over something you own?

100... and I love it when their masks come off. More and more are racist are showing their hand and that's a good thing imo
