No he should not pay off collections. Let it sit there and let them sell it to other agencies. Then, hit them with the letter, asking them to show proof of debt or remove it. This results in the latter 99% of the time.

NEVER PAY OFF COLLECTIONS

Back when I was broke, junk debt buyers sent legal notices, I didn't show up to court, they got the judgment, and wiped my bank account twice. The only way I got that money back was courts not being allowed to take government money, and all that money was my unemployment money. One got so bad, they were going to put a lein on my wages when I got a new job.

If the debts are 700 and up, they aren't going to stop coming after you, and it got really aggressive in year 6, because they knew that debt was about to drop off. Those junk debt buyers are lethal, and will call you 10 times a day. I even tried to settle low, and they wouldn't budge. If the debt is with the original creditor, you can settle low, but the junk debt buyers aren't settling low for high debts.

Yes. And they sent all the verification, all my old statements, and copies of all my old checks. I did this for all the accounts with debt buyers, and only this one followed through. This was back when you used to use checks instead of paying online. If it's a high debt, they will go after you hard. i couldn't believe the amount of effort to collect on 1200. I tried to give them 200. The lowest they offered was 700. There was no way i was paying that to a junk debt buyer, especially when I was dodging others. I even cursed them out on the phone and told them I know they paid pennies. I told that bytch she works for the devil and her karma will come back fo her. I could hear the sound of the tears coming up in the woman's voice the first time. The second time, it was a man, and he hung up, but they still followed through. They hired a local court official that went into people's bank accounts. It was cheaper to file for bankruptcy, and they didn't get one penny. The key is to contact the original creditor before it charges off. I know people that settled for almost nothing, and it never went into collections or got bought by the debt buyer.

My boy owed 4k to Capital One. We helped him erase that debt and paid 0 off it. Maybe your defense was not strong enough, or you didn't have the right language in your letters

I got a judgement by Capital one for 2K, but I have no income/assets/or anything. I don't mind paying it off when I get a job but It looks like I am done for brehs :mjcry:. This gonna be on my Credit Report for 7 years even if I pay it earlier :francis:.

I got a judgement by Capital one for 2K, but I have no income/assets/or anything. I don't mind paying it off when I get a job but It looks like I am done for brehs :mjcry:. This gonna be on my Credit Report for 7 years even if I pay it earlier :francis:.

What you mean by that? Cap already sold my debt to the collectors(some debt attorneys) or whatever that got a judgement on me. But I'm not sure what they are going to do since I have no income or anything. I heard you can dispute the judgement on your CR after you pay it off tho, not sure how true that is.

Well you said CapOne had a judgment against you. So, I would start sending letters of verifications to them nonstop and a cease and desist letter.

This is a new tactic that Republicans use now to get their debt collecting companies to make money off the people. Did you go to court ? Did a judge decide it with you and that attorney ?

Nah default judgement, I was way too clueless on what to do and had no money for a attorney. Also don't think I can handle myself in court on my own cause of my mental illness :francis:. Im going to pay them back eventually, just want to know if I can get it removed from my CR earlier after I pay.:mjcry:

Unfortunately, you can't. I'd consult an attorney. Go to credit message boards, I'm sure you will find something.

I worked with SkyBlue credit repair. That's all I used to do for a living. No credit agency keeps your records for over a year breh. Once your account is sold to collection agencies for pennies, I can guarantee you they don't have any paperwork to back it up.

Once the debt goes to 2 agencies, it's a lost debt unless the person is uninformed enough to pay.

Capital One and Chase are reporting my 2 year old charge offs but collection agencies are still sending me letters.. I already started paying the Cap 1 debt.. I checked my report and my balance is showing that I am making payments.. How does that work?

I asked them both (cap1 and the collection agency) about getting it removed after paying it off and both said I gotta contact the credit bureau but that doesn't make sense to me

If the sold my shyt, why are they still reporting it every month? I would like to get it removed once paid off but is that just a pipe dream?

Cap 1 has like a direct line to the collection agency

you're making payments, so they have 0 incentive to work with you now. That's why I say you never pay them off.

I have two accounts in collections. I could pay them off, but I need them removed. Is this still a good validation template
**For anyone with old accounts in collections** There were a couple of very old items in collections that popped up when I started the home buying process. I don't know if they noticed new activity since my score was going up, or how they even came up. Depending on your states statute of limitations, they may not be able to continue collections process, or they may have to fully remove it from your report. Since the credit cards they were reporting were over 7 years old, they stopped trying to collect after I sent them this letter (a lady at my lender gave to me). You can fix her typos- I just left them :skip:

I am sending this letter to you in response the collection account being reported on my credit history. Be advised, this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for “verification” or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your office provide me with competent evidence that I have any legal obligation to pay you.

    If your offices have reported invalidated information to any of the three major Credit Bureau’s (Equifax, Experian or TransUnion), said action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:

  • Violation of the Fair Credit Reporting Act

  • Violation of the Fair Debt Collection Practices Act

  • Defamation of Character
If your offices are able to provide the proper documentation as requested, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel. This includes any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.


I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls or correspondence sent to any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter.


This is an attempt to correct your records; any information obtained shall be used for that purpose.
