he didnt move the car or take it to the owner...

he took the car on his own time and drove around with it. he fukked up.

but how did he have access to the keys?

i mean all IM saying is "valet drives around like a jerkoff and fukks the car up" is covered in at least the normal valet trips, by anyone who runs these companies

The Liability coverages on a Business Owners Policy explicitly covers employee actions as well while they're doing their duties on behalf of the business. They're responsible(the business), it's a crap shoot with the Insurance company because I KNOW they're going to try to weasel out of it but technically, they'd have to cover it.

These dudes be dreaming too much. :snoop: The only thing I would do if I was working for valet is drive and park the car where it should be, turn it off and just sit in the driver seat and intake all the expense of a luxury car I never drove before. :blessed:

i dont think that was a normal valet trip. he wasnt parking it. moving it to the customer.
none of his actions with that car was involving his valet duties.
so his access of the keys were abused

Couple of things would happen here. First line would be if the valet service has its own policy, then it would be paid under the Garagekeepers portion of the policy as the cars are in their care, custody or control of the valet company. If this is the case, then they were technically in the business of "transporting" or "parking" the vehicle. At least that's how I would try to explain it to the insurance company. The ISO form isn't specific enough regarding this.

If the valet service doesn't have this coverage, then it may fall to the restaurant if they've contracted out, but I'd put my money on them not having coverage on their policy for stuff like this.

Lastly, the personal auto policy would respond to this ultimately. The car wasn't being used in a racing capacity, or something along the lines of that exclusion, and a personal auto policy is pretty broad in its scope of coverage.

any lawyer will bring up that it is known knowledge them type cars do that when you rev the engine carelessly.
gross negligence is carelessness in a serious way.
i dont think insurance will take that bullet on the whole $$ lost.
someone else has to pay.. either they pay out a little or nothing.
i doubt that is covered under insurance. its not an accident. :yeshrug:

I would think the valet company has to carry insurance as they deal with a lot of luxury vehicles down there.

the company in the END might have to pay. doesnt mean that the circumsances involving how or why or who burned the car and almost let it eXPLODE IF FRONT OF A GROUP OF PEOPLE.

gross negligence. that company will get a lawyer and then go after the driver IF the company gets raped because of his stupidity.




calm down. read some books.

Their employee did it. Their insurance is gonna cover it. The kid will get fired, that's all.
