i'll read the story in a second, but based on your abridged version of the article i just wanted to say this: the essence of crime is when you force your will upon someone without their consent based on the laws established by a society, not whether or not there is physical evidence of damage done to someone. crime has more to do with intentions than actual damage. damage is just a way of keeping score...

The "only" damage is psychological. Thats not a something you can just easily glance over, it can be argued that psychological/emotional distress is worse than physical.

Short story even shorter, if somebody rapes a passed out girl and doesn't injure her, give her a disease, or cause any physical discomfort at all (basically, the only damage is psychological), should it be a crime? :ufdup:

Yes, it is stupid, but it seems like people are having a tough time explaining why. :skip:

Because laws are made to prevent people from being hurt. Sure after the "rape" the person may be unharmed. But rape usualy leads to the person being harmed, therefore the law should be made to prevent rape.

For numbers 1 and 2. Porn isn't illegal and it shouldn't be. And environmental concerns are about more than just feelings. Pollution can and does phisicaly harm people.

I think thats one of the points the author is trying to make. Perception of harm whether physical or psychological is subjective, yet most claim certain offences are absolutely and objectively more harmful than others (read his porch light example), can you not see the problem there? I'm obviously not condoning rape but the author raises some interesting points.
