The White House is dismissing a Department of Homeland Security (DHS) intelligence report rebuffing President Trump’s claims that citizens from seven predominantly Muslim countries pose an increased terror threat, the Wall Street Journal reported late Friday.

“The president asked for an intelligence assessment,” a senior administration official told the Journal. “This is not the intelligence assessment the president asked for.”

Trump administration officials claim that the report failed to include available evidence that supports the president’s Jan. 27 order barring citizens from Syria, Iraq, Iraq, Libya, Yemen, Sudan and Somalia from entering the U.S.

That executive order was blocked by a federal appeals court earlier this month, and Trump has said he is crafting a new order that can withstand legal muster.
Acting DHS Press Secretary Gillian Christensen also challenged the agency’s report, calling it an “incomplete product.” But she said the administration’s reason for taking issue with it was not political.

“Any suggestion by opponents of the president’s policies that senior [DHS] intelligence officials would politicize this process or a report’s final conclusions is absurd and not factually accurate,” Christensen told the Journal.

“The dispute with this product was over sources and quality, not politics.”

The DHS report came after Trump reportedly asked the department to help bolster his legal case for implementing the controversial travel ban.

But the findings seemed to directly contradict the president’s key argument, saying that an individual’s citizenship is an “unlikely indicator” of the threat they pose to the U.S., according to the Associated Press.

As a presidential candidate, Trump took a hardline stance on terrorism by Islamist extremists, and often contended that the U.S. was too willing to allow people from Muslim-majority countries to enter its borders.

But his efforts to implement a travel ban on certain countries was met with sharp criticism by many, who accused it of being a de facto Muslim ban and a violation of religious freedom protections.

“The president asked for an intelligence assessment,” a senior administration official told the Journal. “This is not the intelligence assessment the president asked for.”

Pay attention to the extent to which the agencies are contradicting Trump. Mind you, these agencies are now being led by his appointees.

Religious and ethnic tests are not constitutional.

This administration messed up by guiliani stating on TV that it was originally intended to be a muslim ban and also by campaigning on a muslim ban and still having it on their campaign website until this day. So given that it got defeated and will be defeated again because despite on paper not stating its a muslim ban, the intention is clear. The fact they are ignoring this report and will push forward anyways will lead more to a defeat because now the court can say "well your own DHS says this does nothing to keep american's safe".

This shyt is dead and rightfully so. The part of the constitution that references the president's right to ban people from the country is from what I've read from people in law is much more complicated then just the words on the paper. There is a lot of "ifs, ands, and buts" attached to the part of the constitution.

Interesting sidenote in history. When EO 9066 was drafted, the famous order to intern Japanese, it purposely does not state "Japanese" anywhere in the order. Its a short read, and I would recommend people look at how innocuous the order is. Reading it on its own you'd have no idea it was meant to intern Japanese. Reason being is that for a while before that order, Roosevelt was intent on doing something with the Japanese American population out of fears they can be spies and his AG was very adamant that this can't be done and told him not to do it and was very much against it. Roosevelt went and crafted a document that avoid language that mentions the intention without his AG's input.

Just because something doesn't explicitly say it was meant to do xyz doesn't mean the courts can't consider the intention that it was done to do xyz. This administration could have gotten away with it if they never made their intentions known and could provide a convincing argument that it was going to make "America more safe".

But thankfully Trump is a moron who runs his mouth before thinking and surrounds himself with lapdogs who think just popping off at the mouth is "alpha male" behavior instead of stupid.

It doesn't matter if this is a Muslim ban, and I'm not convinced it is; the President has the right.

8 U.S. Code § 1182 - Inadmissible aliens
(f)Suspension of entry or imposition of restrictions by President

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.

That is what I referencing. Its an act not part of the constitution. My bad by the way. But as I said, as you read more surrounding amendments and other laws surrounding this, you realize its not as clear cut. This is selective cherry picking of laws that have exceptions and other caveats attached.

See the following:

The best legal arguments against Trump's immigration ban

Its not as clear cut and there are anti-discrimination laws that prevent a muslim ban from being carried out.

If you don't believe its intended to be a muslim ban after trump stated he wanted to do as much and Guiliani, who helped craft the order, stated on national television that was what was asked of him, then I don't know what to tell you.
