Virginia lt. gov: Sexual assault allegation is a 'totally fabricated story out of the blue'

(CNN)Democratic Virginia Lt. Gov. Justin Fairfax said reports that he committed sexual assault are false and he instead described an encounter that was "100% consensual."

The allegation was first published on the conservative website Big League Politics on Sunday night. Fairfax denied the allegation in a written statement overnight, then again to cameras Monday afternoon.

The Washington Post reported Monday that the woman who says she was assaulted by Fairfax approached the paper in 2017. The Washington Post said they did not report the allegations because "Fairfax and the woman told different versions of what happened in the hotel room with no one else present. The Washington Post could not find anyone who could corroborate either version."

The Post said it did not find "significant red flags and inconsistencies within the allegations," contrary to what Fairfax said in his written statement.

The allegations come amid days of controversy in Richmond around Gov. Ralph Northam's changing story regarding a racist photo in his medical school yearbook showing one person dressed in blackface and another in the Ku Klux Klan's signature white hood and robes. Northam has fought to stay in power despite a cascade of calls for his resignation from nearly every top Virginia Democrat and a series of high profile national elected officials.

Fairfax has not called for Northam's resignation, telling reporters on Monday that the governor "has to make the decision that is in the best interest of the commonwealth of Virginia."

But there are signs that the relationship between Northam and Fairfax, who would become governor if the embattled Democrat stepped down, has deteriorated.

Fairfax told reporters that the last time he spoke with Northam was "probably a couple of days ago." And when asked if it was before the Saturday news conference where Northam changed his story on the racist photo, Fairfax said he didn't believe they had talked since then.
Fairfax, at 39 years old, would be the youngest governor in the country and the only African-American governor, should he take over for Northam.

Fairfax told reporters that the sexual assault allegation is "not only from left field, it was from planet Mars, because it didn't happen."

Fairfax described himself as "someone whohas treated women with respect and always observed certain decorum."
He said he met the woman at the 2004 Democratic National Convention in Boston and said, "We hit it off. She was very interested in me."

"She was very much into the consensual encounter," Fairfax said. "Everything was consensual."


He described the story as a "totally fabricated story out of the b
lue."
"Zero corroboration because it did not happen," he said. "There was not inappropriate contact whatsoever."


"I have lived my life in a way that I am proud of," he said, adding that he has "never had anything like this said about me."

He also noted that, as a former prosecutor, he had "two FBI background checks" and none of this came up.

Fairfax was asked by CNN what he thought the woman's motives were and he said CNN would "have to ask her." He did not respond when asked the same question again.

CNN has not been able to reach the woman. The Washington Post reported that she had not responded to their attempts to reach her for comment.

The Washington Post said Monday the woman accusing Virginia Lt. Gov. Justin Fairfax of sexual assault 15 years ago did not present any inconsistencies in her story, as his office claimed in an overnight statement.




“The Post carefully investigated the claim for several months,” Fairfax’s chief of staff and communications director said in a statement. "After being presented with the facts consistent with the Lt. Governor’s denial of the allegation, the absence of any evidence corroborating the allegation, and significant red flags and inconsistencies with the allegations, the Post made the considered decision not to publish the story.”


The Post, however, said in its story on Fairfax’s denial it did not find “significant red flags and inconsistencies within the allegations,” the statement asserts.


In fact, the paper said it could not find anyone to corroborate either Fairfax’s or Tyson’s accounts of the alleged incident.


The Washington Post didn’t name the accuser. But the paper said Fairfax and the woman met first met in Boston at the 2004 Democratic National Convention.

“The woman described a sexual encounter that began with consensual kissing and ended with a forced act that left her crying and shaken,” The Washington Post reported. “She said Fairfax guided her to the bed, where they continued kissing, and then at one point she realized she could not move her neck. She said Fairfax used his strength to force her to perform oral sex.”

The statement from Fairfax said that before Big League Politics posted about it, “not one other reputable media outlet has seen fit to air this false claim. Only now, at a time of intense media attention surrounding Virginia politics, has this false claim been raised again.”

“The Lt. Governor will take appropriate legal action against those attempting to spread this defamatory and false allegation,” the statement read.

Speaking to reporters in Richmond Monday, Fairfax discussed his relationship with the accuser, saying he was 25 and unmarried when they met at the convention. He denied any wrongdoing, calling it a “consensual encounter.” Fairfax called it a “totally fabricated story” and questioned the timing.

“Such a shame this is weaponized and used as a smear because this is a very real issue,” Fairfax said.

The Big League Politics post that prompted Fairfax's denial published a purported Facebook post from the woman that read, “Imagine you were sexually assaulted during the DNC Convention in Boston in 2004 by a campaign staffer. You spend the next 13 years trying to forget it ever happened. Until one day you find out he’s the Democratic candidate for statewide office in a state some 3000 miles away, and he wins that election in November 2017. Then, by strange, horrible luck, it seems increasingly likely that he’ll get a VERY BIG promotion.”

She did not name Fairfax, but the report implied she was referring to the lieutenant governor.

Clearly Northam's folks pulled her out the dungeon. She made a claim months back, whether true or false, nothing like accusing a black man of sexual assault to hurt his reputation, and if she's white :ohlawd:.

Hypothetically who would be 3rd in line for the Governorship?
