If not attempted murder then pre-meditated felony assault. Because the camera was focused on the victim, meaning he told someone to film it because he planned it. He didn't die but he could've. The kick to the head bent his neck back, he had a broken nose, concussion and had a seizure during the assault.

He's already been charged with 1st and second degree attempted murder. These charges will not be reduced by the judge and they will stick. It's over.

if it were up to me. he'd do a year in juvie, with mandatory anger management counseling. any slipups in his program and he goes to YA until 25. but i dont think sending him to prison will do anything but turn him into a hardened criminal, that will be forced to rely on crime once released.

Crimes aren't charged on the end result, they are based on the intent.

Think about the logic of what you are saying...because he wasn't in a coma the charge shouldn't be high? That's the same thing as saying someone that sprayed an ak47, but missed his targets, shouldn't be charged because no one got hurt. Crimes are based on attempt...the fact this kid wasn't more seriously hurt shouldn't matter...
