CNN Facing Racial-Discrimination Lawsuit Claiming African Americans Receive Lower Performance Ratings in Evaluations

Another major news network is facing allegations in a racial-discrimination lawsuit, stemming from a proposed class action in Georgia federal court. In the lawsuit, plaintiffs claim that at CNN and other Time Warner units, African Americans receive lower performance ratings in evaluations, that there are huge discrepancies in pay between employees doing similar jobs but who are of different races, and that promotion for black employees is blocked by a “glass ceiling.”


According to the Hollywood Reporter, the lawsuit, which was filed in December, cited hiring and advancement statistics. It also accuses superiors of hurling out racially charged comments to black employees, such as “It’s hard to manage black people” and “Who would be worth more: black slaves from times past, or new slaves?”


The Hollywood Reporter says that the CNN case may grow exponentially. The defendants filed a motion to dismiss the case or at least acquire more definitive statements about specific allegations. Defendants also allegedly argued that some of the claims may be barred by the statute of limitations, or by the fact that the plaintiffs did not fully exhaust administrative remedies. At that point, the plaintiffs stepped forward, telling the judge that they wished to file an amended complaint.

“Since the filing of this action, counsels for the plaintiffs have been contacted by more than 175 people, both former and current employees of the Defendant, requesting to be members of the putative class action, all having similar complaints of intentional racial discrimination, discrimination impact and discriminatory practices employed by the Defendants,” the plaintiff’s motion, which was filed in March, read.

Time Warner has until April 14 to respond to the motion to amend the complaint.

The new development comes after Fox News was also slapped with a racial-discrimination lawsuit.


Last month, two black women filed a federal lawsuit in New York claiming that they were subjected to “top-down racial harassment” in the organization’s payroll department.

Tichaona Brown, a payroll manager, and Tabrese Wright, a payroll coordinator, accused now-former Controller Judith Slater of making several racially charged comments, including suggestions that black men were “women beaters” and black people wanted to physically harm white people, among other allegations.

And, just Tuesday, another black female employee with the network’s payroll department joined that lawsuit. New York magazine reports that Monica Douglas, a manager for credit collections, said that she was also subjected to years of racist comments at the hand of Slater. Douglas claims that Slater complained that she had “black eyes,” in comparison with the “Aryan race,” which has blue eyes and blond hair, and that Slater also called her Brooklyn, N.Y., neighborhood the “murder capital of the world” and voiced “an unwillingness to even be near black people.”


Variety reports that Slater would also allegedly rub her hands in Douglas’ hair and even kicked her in her backside as she walked down the hall. Slater is also accused of insulting Douglas’ Panamanian heritage and mocking her accent.

To add insult on top of insult and injury, Slater reportedly even mocked Douglas about having a mastectomy as a result of breast cancer, calling her “one-boobed girl” and “cancer girl,” among other examples of ridicule.

An ex-CNN and current TBS employee are spearheading a class action lawsuit against Time Warner, claiming its companies have been mistreating black managers since the late 1990s.

Celeslie Henley and Ernest Colbert Jr. are suing CNN, along with Turner Broadcasting and Time Warner, according to a lawsuit filed Tuesday in Georgia federal court.

Henley says she worked for CNN for seven years as an executive administrative assistant and was fired five days after she emailed human resources about discriminatory treatment. Colbert works for TBS and claims that he is underpaid compared to his white peers.

Their suit claims the internal policies ensure black employees aren't promoted as often or to positions as high as are white employees.

"As a result, jobs are filled without being posted, candidates are handpicked in advance, and supervisors who make hiring decisions have implemented 'preferred qualifications' to mask the prejudicial preference in their candidate selection," writes attorney Daniel Meachum in the complaint. "Indeed, although African-Americans make up about 30-35 percent of the employees in the mid-level managerial and staffing positions, they are extremely under-represented at higher pay grades and senior positions."

In addition to "glass ceilings" for advancement, the complaint also says there are "glass walls" that segregate the company into divisions in which black leadership is acceptable and divisions in which it is not.

Henley and Colbert also claim a lack of meaningful oversight in performance reviews allows managers to make evaluations and leads to African-Americans receiving lower scores.

"Upon information and belief, African-American employees have had to endure racial slurs and prejudicial biases from their superiors such as, 'it's hard to manage black people' and 'who would be worth more: black slaves from times past, or new slaves," writes Meachum.:francis:

According to the complaint, high-level officials at the company are aware of the problems but look the other way.

A Time Warner representative told The Hollywood Reporter in an email Thursday morning that the company has not yet been served the complaint and will decline comment at this time.

Henley and Colbert are asking the court for an injunction preventing the alleged discriminatory conduct, the award of lost wages and compensatory and punitive damages.

The proposed class is defined as: "All African-American persons employed by Defendants in salaried positions and mid-level managerial positions (specifically, managerial positions inferior to the Director, Vice President, Senior Vice President positions) in the United States at any time from April of 1997, to the present, who are subject to Defendants' employment and human resources policies and practices, including, but not limited to, current or former salaried employees of Turner Broadcasting Systems, including Turner's subsidiaries, Time Warner, Inc., and Turner Services, Inc. and who have been, continue to be, or may in the future be, adversely affected by Defendants' racially discriminatory employment policies and practices."

Head-quarted in Atlanta too and this is just now surfacing? Atlanta has a big Black population, how long did they think this would go on? CNN is fake news anyway. O'Keefe exposed them for lying for ratings.
