Even if they can't (realistically) work something out with Fox, they need to at least negotiate whatever needs negotiating with Universal so they can use the rights with Namor and bust this out:

BP's original release date: November 3, 2017
JLA Part 1's release date: November 17, 2017
BP is already deep in unexplored territory for a film (Black superhero film centering on technologically advanced African country and a strong, intelligent and confident Black main character).
JLA would have utterly destroyed BP's momentum.
