so of that's the case why not penalize a defender for nugging a guy who is already slightly out of bounds?

what are you talking about? there is a late hit flag for that too

if the defender makes an additional football move in order to create contact after a play is "dead" its a late hit

its a pretty simple rule. the easiest way to check for it is by the number of steps a defender takes
