If this is so and they are dropping his charges altogether, The State is getting this wrong. You can't "self-defense" with lethal force if there is no lethal threat, especially if you aren't threatened...
But there are all kinda loopholes in the game if you either have a good lawyer, weak prosecution, or you know how to hunt the loopholes and mine the nuanced grey areas. In a case like this as described, I'd expect reduced charges probably but dropping altogether is gonna get someone at the DA office suspended, demoted, or fired...
