If this is so and they are dropping his charges altogether, The State is getting this wrong. You can't "self-defense" with lethal force if there is no lethal threat, especially if you aren't threatened...

But there are all kinda loopholes in the game if you either have a good lawyer, weak prosecution, or you know how to hunt the loopholes and mine the nuanced grey areas. In a case like this as described, I'd expect reduced charges probably but dropping altogether is gonna get someone at the DA office suspended, demoted, or fired...

My guy..... legally you're not allowed to rob and shoot at ppl either, but they did that they both were also already felons so legally he shouldn't have a gun in his hand to begin with. Von got killed and he pinned everything on him (which doesn't even make sense because there's video.). The guys suspect he is telling....

If a serial killer and his entourage swarm and attack you I would say there is reasonable concern to believe the threat could be lethal. At the end of the day it's better to be tried by 12 than carried by 6.
