I'm kinda sick of these guys bytching about stuff like this. All this exist in some hypothetical bubble because while all these guys talk that we make money shyt none of them will lawyer up and take Nintendo, YouTube, or any of these game companies to court to establish a legal precedent. If you wanna call this fair play and say you have a legal right to do it then go to court and establish the precedent. Which btw none of the parties involved want to happen because they could lose the case and all the bullshyt power they hold right now.

You know what happens instead? Nintendo announces policies that may or may not be legal on YouTube and Joe knew the shyt up front. That Nintendo has its own partner program and if you aren't in it they plan to take all ad revenue from any videos featuring their games. Joe and all the other YouTubers roll over and let them do that whether or not it's legal or not then cry when it happens.

What you never see them do is say this is my using a piece of software I purchased legally and uploading it to a channel I have rights to legally and that's fair use and I have the rights to that footage so see you in court a$$holes.

He's been doing youtube video's without doing a single Nintendo video and he's been doing fine. If he can't make money off of Nintendo products he can just simply continue not cover them.:yeshrug:


Or just use Blip TV since Nintendo ignores that but don't tell Joe that.

It's Nintendo's right to do with their IP what they want. It just seems out of touch to me. If they could somehow manage to take a small cut off the top from people and let them do what they want channel wise i'd say ok. It becomes a waste of time for almost everyone to make Nintendo related videos with this system in place. shyt FIFA gets an absurd amount of exposure and fan participation off youtube.

If you buy a game or any piece of software and record yourself playing / using it who actually owns the rights to that video footage? You? The software maker? Mind you that you legitimately purchased the device required to play the software and the software itself.

You can upload said video to Youtube and it's ok but if you make any profit on it due to the potential monetization on YouTube the software maker suddenly claims they own the rights to it.

Nintendo is is the business of selling software and hardware to end users. It was those end users that put two and two together and figured out a way to make money on YouTube after the fact. Personally I don't feel Nintendo should have any rights to that but that's up to the courts to decide if it ever happens.

Dude is crying because Nintendo won't let him make money off their product...

Thing is, he knew full well about Nintendo's policy about putting their games up on Youtube and knew that he would get a copyright claim but chose to upload the video anyway( it's the second time in fact, first time was in January of this year).

What's crazy is that in the video he says he bought his Wii U but he forgets to mention that his fans came together and donated the money to buy the Wii U for him.
