According to the law of Resisting Arrest in New York, if you prevent or attempt to prevent a police officer from placing you under arrest where he or she is authorized to do so you are guilty of an "A" misdemeanor.
What gives the police the "upper hand" when charging Resisting Arrest is that it merely takes minimal actions by the accused to satisfy the elements of the crime. For example, if you swing your arms or hold them up so that you cannot be handcuffed, that is likely sufficient to establish the crime. You need not behave violently. Certainly, the specific facts of your case must be analyzed, but if you intentionally try to stop the police from effectuating an authorized arrest it is likely you will face this charge.

yeah the issue i'm having with this is that there are 2 other cops standing very near that aren't assisting because CLEARLY the shyt is under control.The flying punch was unnecessary, but...........
because he didn't do anything from what i've gather, they were the wrong kids. SO yeah a 12 year old kid (assuming that's his age) might see that as unfair and not be mentally able to make those types of decisions correctly.And you didn't bother asking why it took THREE officers to hold him down?

So let me see if i'm understanding what you're saying...If he didn't do anything, he had no reason to struggle with them. If he had cuffs on him, then he obviously started something he couldn't finish. I got arrested/detained when I was that young and all they did was put me in the back of the police car. No cuffs. Walked outta the department a couple hours later with no record and not charged with anything. They even gave me cab fare home and apologized for detaining me.
Kids need to be educated on how to deal with police. Reacting violently against them gets us nowhere but in jail/prison or dead.

We do know why they were there, the cops presumably responding to the scene also knew.they were still trying to cuff him at that point.
That hysterical woman made the situation seem worse than what it was.
Plus, we dont know what those kids did in the first place.
Age of the kid means nothing...I know first hand that a lot of older dudes give the shorties the work/guns because they cant get into too much trouble.
