It cant be proven. It has to be taken on a case by case basis and that basis being the reaction and effect that occurs because of the hate speech but as human beings, we're smart enough to know with a little investigation. In the case of the man who made this film, the intent was obvious and he should be fined. Im sorry, i just cant be seen talking to a demon like you. I guess pride really does come, before the fall. And on what legal grounds do you determine the threshold of "was funded to incite violence"?

Do you not see that as a slippery slope of censorship that flies in the face of the first amendment?

Are you saying free speech should be curtailed commensurate with what the expected response will be by those who are offended? If so, then all people have to do is act out in violence whenever someone expresses an opinion they don't like to effectively silence them.

Here's the difficulty, though, friend. If we measure it by reaction and effect, then intention must go out the window. Something can have a good intention and cause a horrible effect, or have a bad intention but then cause a good effect. So if we had such a law, and it worked for judging this movie guy, we couldn't guarantee that it would work for everyone else who did similar things. Then people in power could use the law for demonic purposes to silence disagreements or to take out people they didn't like, even if they didn't really do anything wrong.
