I don't know the contours of the NBA arbitration agreement, but arbitrators have wide latitude in how they do things. I would never make a sure bet on that. As far as the tapes go, just because it cannot be used against him legally, it does not mean that the owners cannot bring it up. There is nowhere in the constitution that they say that the evidence is only evidence that would be otherwise permissible in court. He lost, plain and simple.
If I remember correctly, the arbitration clause in the NBA Constitution is bounded by the FAA rules. They do have wide latitude, but the thing is this tape wouldn't even be admissible in regular litigation. I think there's a good chance an arbitrator would allow it to be admissible.

Exactly how I feel. Hell, to be fair, a lot of Black people and anybody else for that matter would be in the hot seat with HR if their private conversations were recorded as well. If Indians and Asians were forced to speak English when around English only speaking people, they'd be in trouble too. As far as Sterling is concerned, it couldn't have happened to a better person, but damn it makes me uneasy considering all the nonsense I've said throughout the years. Lot of people loving this, but if they were under the same microscope, there's a possibility they'd be uneasy to say the least.

It was taken care of after him and his team combed through everything they can do.

sitting out wouldve let silver cook, he just wouldve had to cook faster....they wouldnt have needed 72 hours to do this...he wouldve called an emergency owner's meeting the next day....

the only reason sterling got a lifetime ban is because the players have been very vocal about the situation and silver knows they would boycott

that shows you how powerful a statement a boycott would have made

them boycotting would have obviously led to the same end, but it would have looked better for blacks because our players would have grabbed their nuts and made this happen themselves instead of waiting for the commissioner to save the day

This whole result is the slaves begging another plantation owner to intervene on their behalf, instead of killing the slavemaster family ( figuratively in this case of course)
